Booking and Cancellation Policy

1. Scope of Application
This booking and cancellation policy applies to all appointments booked via the online booking system of Amara Noir, Juch 12, 5622 Waltenschwil.
By completing a booking, the customer agrees to these policies.
2. Contractual relationship
The booking constitutes a binding appointment reservation with the selected independent service provider.
The contract for personal or intimate services is concluded exclusively between the customer and the respective service provider.
Amara Noir merely provides the technical booking platform and the premises and is not a party to the contract for personal services.
3. Conclusion of the contract
Upon completion of the booking, a binding contract within the meaning of Art. 1 OR is concluded.
The customer undertakes to attend the reserved appointment or to cancel it in good time.
4. Binding nature of the booking
The booking is binding.
Appointments that are not kept or are cancelled late cause the service provider financial loss due to loss of earnings.
In the event of conduct contrary to the contract, the customer is liable for the resulting damage in accordance with Art. 97 of the Swiss Code of Obligations.
5. Free cancellation
Free cancellation is only possible up to 24 hours before the booked appointment.
Cancellations must be made via the booking system or in writing (e.g. by email).
The date of receipt of the cancellation is decisive.
6. Cancellations less than 24 hours in advance / No-shows
In the event of cancellations less than 24 hours before the booked appointment or in the event of a no-show by the customer, the respective service provider is entitled to demand compensation amounting to 100% of the agreed booking price, provided that the appointment could not be filled by another customer.
This compensation is based on the statutory provisions on damages pursuant to Art. 97 ff. OR and on default of acceptance pursuant to Art. 91 OR.
The customer remains obliged to pay if the service provider suffers an actual loss of earnings as a result of the late cancellation or no-show.
Any loss of income or other allocation of the appointment shall be taken into account.
7. Late arrival
If the customer arrives late, the booked service time shall be shortened accordingly.
There is no entitlement to an extension of the booking time.
In the event of a significant delay, the service provider may consider the appointment a no-show within the meaning of Art. 91 OR.
8. Deposit (optional, recommended)
A deposit may be required to secure the booking.
This is considered a partial payment of the agreed booking price.
In the event of late cancellation or no-show, the deposit shall be forfeited as compensation for loss in accordance with Art. 160 para. 2 of the Swiss Code of Obligations, insofar as and for as long as the appointment could not be reallocated.
In the event of timely cancellation, the deposit shall be refunded or credited towards a new appointment.
9. Cancellations by the service provider
If a service provider has to cancel an appointment for unforeseeable reasons, any deposit already paid will be refunded in full.
No further claims shall be accepted.
10. Payment terms
Payment for personal or intimate services shall be made directly on site at the premises of Amara Noir.
Payment is processed on the premises.
The specific scope of services, the price and the payment terms are agreed between the customer and the respective self-employed service provider.
Amara Noir is not a contractual partner for personal services and accepts no liability for price agreements or service content between the customer and the service provider.
11. Misuse and blocking
In the event of repeated short-term cancellations, no-shows or abusive bookings, Amara Noir reserves the right to exclude the customer in question from the booking system.
12. Applicable law and place of jurisdiction
Swiss law applies exclusively.
The place of jurisdiction is Waltenschwil (AG).
13. Severability clause
Should individual provisions of this policy be invalid, the validity of the remaining provisions shall remain unaffected.
14. Amendments to the policy
Amara Noir reserves the right to amend this policy at any time.
The current version published in the booking system and on the website shall apply.
